Terms of Use for Online Medical Consultation Services for Foreign Visitors to Japan

These terms of use (these "Terms") stipulate the conditions for the use of the online medical consultation support services for foreign visitors to Japan (the "Support Services") provided by M3 Career, Inc. ("M3C") and the online medical consultation services for foreign visitors to Japan (the "Online Medical Consultation Services") provided by M3C’s partner medical institutions (the "Partner Medical Institutions") to an individual who is foreign visitor staying at M3C’s partner facilities within Japan (such facilities, the “Partner Facilities”; and such individual, the "User"). The Company and the Partner Medical Institutions are collectively referred to as the "Service Providers," and the Support Services and Online Medical Consultation Services are collectively referred to as the "Services."

  1. (Use of the Services)
    The User shall agree to these Terms to use the Services, and these Terms apply to all relationships between the User and the Service Providers related to the use of the Services.
  2. (Agreement for Use of the Services)
    The User agrees to the following conditions when using the Services:
    1. The User acknowledges that information obtained from online medical consultations is limited due to reasons such as the inability to perform physical examinations, and that there are limitations to medical consultations conducted online. User understands that they may be instructed by the doctor to undergo an in-person consultation at another medical institution.
    2. The User shall not record, video, photograph, publish, post, or disclose any of the medical consultation content.
    3. Prescriptions for the following cannot be provided through the Online Medical Consultation Services:
      1. Narcotics, sleeping pills, and psychoactive drugs such as anti-anxiety medications;
      2. Medications requiring special safety management for patients whose underlying conditions are not fully understood; and
      3. Prescriptions more than 8 days for patients whose underlying conditions are not fully understood.
    4. The User shall not share the doctor's account information or any related information with third parties (including family members and friends) not involved in the consultation.
    5. The Online Medical Consultation Services do not guarantee results such as recovery, and the Service Providers assume no responsibility for the outcomes unless due to intentional or negligent actions by the Service Providers.
    6. The User acknowledges and accepts the risks related to security and privacy when using the Online Medical Consultation Services.
    7. In order to improve the quality of the Services, the Service Providers may record the use of the Services.
    8. The User must use their own smartphones, tablets, computers, etc., to access the Online Medical Consultation Services. Security measures for the device are the responsibility of the User, and communication fees incurred during the use of the Services shall be borne by the User.
  3. (Prerequisites)
    1. The User represents and warrants that they meet all the following conditions to use the Services:
      1. The User is a foreign visitor staying at the Partner Facilities within Japan.
      2. The User can verify their identity using the passport.
      3. The User has installed the Zoom application on their own smartphones or other devices.
      4. The User has a stable internet connection sufficient for video calls (if the facility’s Wi-Fi is inadequate, switching to cellular connection is recommended).
      5. The purpose of using the Services is not related to any of the exclusions listed below (the “Exclusions”)(the User is encouraged to visit a nearby medical institution for these conditions):
        1. Fractures or other injuries
        2. Diseases of children under 6 years of age
        3. Symptoms difficult to assess via online consultation
        4. Emergency symptoms
      6. The User must comply with the provisions of these Terms.
    2. The following prerequisites apply to the Services, and the User agrees to use the Services according to the following prerequisites:
      1. The User cannot use the Services for the Exclusions.
      2. Medical interpreters arranged by M3C will be present during the Services.
      3. If a family member or other related person is to be present during the consultation, the User shall notify the Service Providers in advance and obtain their consent.
      4. The User shall use the Services in a quiet, private environment in the Partner Facilities where User’ health information will not be disclosed to third parties.
      5. If the User seeks reimbursement from their insurance company for the cost of the Services, the User is responsible for dealing with their insurance company directly, and the Service Providers have no obligation to assist in this process.
      6. If the User fails to join the designated Zoom meeting by the time specified by M3C (or any grace period specified by M3C), the Service Providers may treat it as a cancellation due to the User's convenience.
      7. If the User notifies the Service Providers in advance about religious considerations, the Service Providers will accommodate them as much as possible, but such accommodation may not always be possible.
      8. The User must comply with any instructions given by the doctor, nurse, or other staff of the Service Providers during the use of the Services.
      9. The Online Medical Consultation Services are provided by doctors affiliated with the Partner Medical Institutions as a medical treatment not covered by insurance and within the limits of what is possible via online consultation.
      10. The cost of medications is to be paid separately by the User to the dispensing pharmacy.
    3. If the User does not meet any of the prerequisites listed in Paragraphs (1) and (2) of this Article, the Service Providers may treat this as a cancellation due to the User's convenience, discontinue the provision of the Services, and charge a cancellation fee pursuant to Article 6.
  4. (Provision of the Services)
    1. If the User introduced to M3C from the Partner Facilities apply for the Services according to these Terms, and M3C agrees, the Service Providers shall provide the Services to the User.
    2. The Support Services consist of the following. Note that Support Services do not include medical acts. M3C provides the User with the necessary support for using the Online Medical Consultation Services, based on the instructions received separately from the Partner Medical Institutions, and M3C assumes any further responsibility.
      1. Pre-consultation counseling by a nurse-qualified staff;
      2. Introduction to Partner Medical Institutions providing Online Medical Consultation Services and scheduling of appointments;
      3. Arrangement of medical interpreters for the User during the Online Medical Consultation;
      4. Communication of pre-consultation counseling information to the Partner Medical Institutions;
      5. Support for sending prescriptions to designated pharmacies; and
      6. Provision of pre-consultation counseling and online consultation details to the Partner Facilities when deemed necessary by the Company.
    3. The Online Medical Consultation Services consist of the following:
      1. Provision of online medical consultation as a medical treatment not covered by insurance; and
      2. Issuance of necessary prescriptions.
    4. The appointment of the Online Medical Consultation Services scheduled in the course of the Support Services may be necessary to be rescheduled depending on the availability of the Partner Medical Institutions or doctors. M3C endeavors to ensure that the time between the end of the Support Services and the start of the Online Medical Consultation Services does not exceed three hours.
  5. (Fees)
    The User shall pay M3C the fees for the Services as determined by M3C in advance, via credit card or other payment methods designated by M3C.
  6. (Cancellations)
    1. If, after receiving User’s application, the Service Providers determine that the Services are not able to be provided, the Service Providers may cancel the provision of the Services. If cancellation occurs after the payment of the fees by the User in accordance with Article 5, the Service Providers shall refund the received fees.
    2. If, after applying for the Services, the User cancels the Support Services or the Online Medical Consultation Services due to the User's convenience, such User shall pay M3C a cancellation fee equivalent to the fees for the Services through method specified by M3C.
    3. If the payment of the fees pursuant to Article 5 has not been completed within 30 minutes after application for the Services, the application shall be deemed to have been void.
    4. If the User fails to attend the Online Medical Consultation Services despite the Online Medical Consultation Services are scheduled within 3 hours of the end of the Support Services pursuant to Paragraph 4 of Article 4, it shall be treated as a cancellation due to the User's convenience.
  7. (Handling of Personal Information)
    1. The Service Providers shall handle the personal information of the User appropriately pursuant to privacy policies of M3C and the Partner Medical Institution, the Personal Information Protection Act and other laws and regulations.
    2. In addition to cases stipulated in the privacy policies and the Personal Information Protection Act, the Service Providers may provide the User's hearing contents, medical consultation contents, or other information to emergency services or Partner facilities at the time of reservation, in an emergency, or in case the Service Providers deems it necessary, and the User is deemed to have agreed to this arrangement.
  8. (Service Provider Responsibility)
    The Service Providers shall make efforts to provide quality services with the care of a prudent manager.
  9. (Prohibited Actions)
    The User is prohibited from engaging in the following acts when using the Services:
    1. Providing information obtained through the Services to third parties, excluding the primary doctor and family members;
    2. Allowing third parties to use the User's status in the Services;
    3. Causing harm or disadvantage to other corporate or individual members, third parties, or M3C, or engaging in acts that pose such risks;
    4. Engaging in criminal acts or acts connected to criminal acts, or engaging in acts that pose such risks;
    5. Engaging in profit-seeking activities or preparing for such activities through or in connection with the Services without M3C's approval;
    6. Interfering with the operation of the Services;
    7. Damaging the reputation of the Services;
    8. Impersonating others to use the Services;
    9. Violating or attempting to violate laws and regulations; and
    10. Other acts deemed inappropriate by M3C.
  10. (Suspension of Service Provision)
    1. The Service Providers may suspend or interrupt the provision of all or part of the Services without prior notice to the User if Service Providers determine any of the following conditions are met:
      1. Maintenance or updating of the computer system related to the Services;
      2. Provision of the Services becomes difficult due to force majeure events such as earthquakes, lightning, fires, power outages, or natural disasters;
      3. Computer or communication line failures due to accidents; or
      4. Other cases where M3C determines that the provision of the Services is difficult.
    2. The Service Providers are not responsible for any disadvantages or damages suffered by the User or third parties due to the suspension or interruption of the Services, for any reason.
  11. (Liability for Damages)
    If the Service Providers cause damage to the User in connection with the provision of the Services and assume liabilities for compensation of damages regardless of the provisions of these Terms, the Service Providers shall be liable only for ordinary damages and to the extent not exceeding the amount equivalent to the fees already paid by the User for the Services, and the Service Providers are not liable for lost profits or damages arising from claims for compensation from third parties. This limitation of liabilities shall not apply to damages caused by intentional or gross negligence.
  12. (Exclusion of Anti-Social Forces)
    1. The Service Providers and the User represent and warrant that they (including major investors, officers, and similar persons) are not and have not been, for the past five years, members of organized crime groups, members of such groups, quasi-members of such groups, or other persons engaged in anti-social activities (collectively, “anti-social forces”), and that they will not have any relations with the anti-social forces in the future.
    2. The Service Providers and the User pledge not to engage in violent demands, unreasonable demands beyond legal responsibilities, threats, or violence, nor to spread false rumors, use fraudulent means, or otherwise damage the credit of the other party or obstruct their business, or any acts equivalent to such activities.
    3. If it is discovered that the other party has violated the representations in Paragraph 1 or the pledges in the preceding two paragraphs, the Service Providers and the User may immediately terminate the contract related to the use of the Services without any notice. The terminating party shall not be liable for any damages arising from such termination.
  13. (Changes to these Terms)
    M3C may change these Terms without the Users' consent. The modified Terms will take effect when posted or displayed on the website designated by M3C.
  14. (Prohibition of Transfer of Rights and Obligations)
    The User may not transfer or assign its status, rights, or obligations under these Terms to any third party without the prior written consent of M3C.
  15. (Governing Law and Jurisdiction)
    1. The interpretation of these Terms shall be governed by the laws of Japan.
    2. In the event of any dispute arising in connection with the Services, the Tokyo District Court shall have exclusive jurisdiction.
  16. (Language)
    The Japanese version of these Terms shall be the official text. In the event of any inconsistency or discrepancy between the Japanese version and any translation made in a language other than Japanese, the Japanese version shall prevail in all respects.
